Kim Zolciak Subpoenaed in Man’s Divorce Case Over Alleged Gifts and Communications

Kim Zolciak has been drawn into another legal battle, this time as part of a man’s ongoing divorce from his estranged wife, who is demanding the Real Housewives of Atlanta alum answer questions about gifts and financial ties.

According to court documents, Zolciak, 47, was served with a subpoena on September 30, requiring her to appear for a deposition in connection with Kyle Mowitz’s divorce from Jillian Green.

The filing states that Zolciak was served in the parking lot of a Georgia high school. Her attorney later responded to the request for her to appear on October 15 and provide various documents and communications.

Zolciak, however, objected to the demand, calling the subpoena “unreasonable, oppressive, and intended to annoy and embarrass her.”

The subpoena reportedly sought all communications between Zolciak and Mowitz, as well as any correspondence involving payments, services, or gifts exchanged between the two. It also asked for details regarding travel arrangements, itineraries, and expenses for any trips they may have taken together.

In addition, Green’s legal team requested “any documents regarding or about Zolciak’s financial relationship with Kyle Mowitz, including but not limited to gifts given or received from Kyle, expenses paid on her behalf… monies loaned to her and monies paid to her by Mr. Mowitz or any businesses with which he is connected.”

Mowitz’s attorney, Marvin Solomiany, said in a statement, “We are not going to litigate the facts surrounding our client’s divorce case outside of the applicable legal proceedings. … Ms. Mowitz’s decision to involve [Zolciak] in the divorce case is highly unnecessary as any relationship our client may have with her only began after the parties’ separation.”

Mowitz filed for divorce from Green in March, citing June 24, 2017, as their date of marriage. The couple, who share two young children, are currently living separately in Georgia. Mowitz requested joint legal and physical custody and argued that Green does not require spousal support, describing her as “an able-bodied adult capable of gainful employment.”

Green countered one month later, requesting primary physical custody and child and spousal support. She also alleged that her estranged husband managed their “substantial wealth” through a family trust he created in 2021.

According to Green’s filing, the trust, reportedly valued at more than $100 million, was established while Mowitz was “engaged in an extra-marital affair and contemplating divorce.” She further claimed that he transferred the majority of their assets into the trust and maintained full control, leaving her “in the dark” about their finances.

Zolciak, for her part, is currently entangled in her own high-profile legal and financial disputes with her estranged husband, Kroy Biermann, as their divorce proceedings continue
